The purpose of the selection criteria in the EU public procurement is to substantiate that a tenderer is able to provide a service as needed by a contracting authority or entity.

The Communication from the Commission ‘Guidance on the participation of third country bidders and goods in the EU procurement market’[1] provides that ‘(…) economic operators from third countries, which do not have any agreement providing for the opening of the EU procurement market or whose goods, services and works are not covered by such an agreement, do not have secured access to procurement procedures in the EU and may be excluded.’

The EU-China Comprehensive Agreement on Investment does not regulate the individual behaviour of Chinese companies in third markets.
