Answer to Written Question: Commission position regarding the Oltenia Energy Complex

On 5 February 2021, the Commission opened an in-depth investigation to assess whether Romanian support measures totalling around EUR 2 billion in favour of majority state-owned lignite-based electricity producer CE Oltenia would be in line with EU rules on State aid. In particular, the Commission is investigating whether the restructuring plan and the aid to support it satisfy the conditions of EU rules on State aid to companies in difficulty.
The Commission will take into account the submissions by Romania and observations of third parties when taking a final position. The Commission cannot prejudge the timing or outcome of the investigation.
Third parties had until 19 April 2021 the possibility to submit to the Commission their comments on the opening decision, and after transmitting those submissions to Romania, the Romanian authorities will have one month to reply to the comments received.
